3. Cancellations and Refunds

  • Client Cancellations: If you need to cancel or reschedule your session, please notify us as soon as possible. Deposits are non-refundable, but we may offer to reschedule your session at our discretion, subject to availability.
  • Photographer Cancellations: In the unlikely event that we must cancel your session due to unforeseen circumstances, we will offer to reschedule or provide a full refund of any payments made.
  • Force Majeure: We are not liable for delays or cancellations due to events beyond our reasonable control, including but not limited to natural disasters, illness, or government restrictions.

4. Delivery of Photographs

  • Turnaround Time: We strive to deliver edited photographs within the timeframe specified in your agreement. Delivery times may vary depending on the nature of the session and workload.
  • Delivery Method: Photos are typically delivered via secure online galleries, download links, or other agreed-upon methods.
  • Storage: We recommend that you download and back up your images promptly. We are not responsible for the permanent storage of your files unless otherwise agreed in writing.

5. Copyright and Usage

  • Photographer’s Copyright: Unless otherwise agreed in writing, FD Photographer retains the copyright to all images produced. This includes the right to use images for portfolio, website, social media, marketing, and promotional purposes.
  • Client Usage: Clients are granted a license to use the delivered images for personal or commercial purposes as specified in their agreement. Images may not be altered, sold, or distributed to third parties without our written consent.
  • Model and Property Releases: It is the client’s responsibility to obtain necessary permissions or releases for any individuals or properties featured in the photographs, unless otherwise arranged with FD Photographer.

6. Use of Client Images

  • By booking our services, you grant FD Photographer the right to use images from your session for portfolio, website, social media, and promotional purposes, unless you request otherwise in writing prior to your session.
  • If you wish to restrict the use of your images, please notify us in advance, and we will respect your preferences.

7. Client Responsibilities

  • Accuracy of Information: You agree to provide accurate and complete information when booking and communicating with us.
  • Cooperation: You agree to cooperate during the session and follow reasonable instructions to ensure the best possible results.
  • Conduct: We reserve the right to terminate a session without refund if clients or participants engage in inappropriate, unsafe, or illegal behavior.

8. Limitation of Liability

  • To the fullest extent permitted by law, FD Photographer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services.
  • Our total liability for any claim arising from your use of our services shall not exceed the amount paid by you for the specific service in question.
  • We are not responsible for loss or damage to personal property during a session, or for circumstances beyond our control that may affect the outcome of your photographs.
